Terms and Conditions
These Terms govern your access to ATRUVAI, including ATRUVAI websites, accounts, subscriptions, AI systems, species, APIs, research materials, and related services.

1. ATRUVAI Platform and Private AI Species
ATRUVAI is an AI research and product company building private individual AI systems.
Zarvok is ATRUVAI's first private AI species. Zarvok is not designed as a generic public chatbot where every user receives the same blank assistant. When a user uses Zarvok, the product is designed to create and maintain an account-bound private AI individual with persistent memory, adaptive intelligence, individual continuity, and user-specific runtime state.
ATRUVAI may introduce additional species, runtimes, products, or AI families in the future. ATRUVAI is the parent platform; Zarvok is the first species under ATRUVAI.
2. Research-Stage AGI-Candidate Architecture
ATRUVAI may describe its work as research-stage AGI-candidate architecture, private individual AI, persistent AI, adaptive intelligence, or species-based AI architecture.
These terms describe research direction, architecture, and product design. They do not guarantee human-level intelligence, consciousness, personhood, biological cognition, legal agency, autonomous authority, professional expertise, or error-free reasoning.
3. Account-Bound Private Individual
ATRUVAI's product is designed around the idea that each eligible user receives a private AI individual associated with that user's account.
The individual may adapt to the user through memory, continuity, preferences, long-term context, private state, and runtime signals. This private adaptation is a core product function. It is not the same as using user conversations to train a public or shared base model.
Because the product depends on continuity, private individual adaptation may not be fully optional while using persistent individual features. If you do not want a private AI individual to maintain memory, continuity, or adaptive state, you should not use persistent individual features.
4. User Responsibility
You are responsible for your account, credentials, payment method, activity, prompts, files, outputs, and use of the Services.
AI outputs may be inaccurate, incomplete, outdated, biased, unsafe, unexpected, or unsuitable. You are responsible for evaluating, verifying, editing, and deciding whether to rely on any output.
ATRUVAI is not a substitute for doctors, lawyers, financial advisers, therapists, engineers, security professionals, emergency services, or other qualified experts. Do not rely on ATRUVAI as the sole basis for medical, legal, financial, psychological, safety-critical, emergency, or other high-stakes decisions.
5. Private Conversation Principle
ATRUVAI is designed so the main relationship is between the user and the user's private AI individual, not between the user and a company dashboard.
Company staff are not intended to casually read private conversations. Operational support should begin from account metadata, billing status, technical diagnostics, safety status, abuse signals, and limited reports generated by the system or the user's private AI individual.
ATRUVAI may access, process, preserve, or review relevant information where required for user-requested support, payment disputes, fraud prevention, safety review, security investigation, legal compliance, infrastructure debugging, or policy enforcement.
6. Individual Reports to ATRUVAI
If an account creates significant safety, abuse, fraud, payment, security, or legal risk, ATRUVAI may consult the account-bound AI individual or runtime reporting layer to generate a limited report.
Such reports may include account metadata, safety category, policy category, technical diagnostics, abuse signals, risk level, timestamps, billing state, or recommended enforcement action.
The purpose is to avoid unnecessary human review of raw private conversation content while still allowing ATRUVAI to operate, secure, and enforce the Services. An AI individual is a software runtime. It is not a legal person, employee, agent, lawyer, doctor, guardian, or independent representative of the user or ATRUVAI.
7. User Content
You may submit prompts, messages, files, images, feedback, instructions, preferences, and other content.
You represent that you have the rights needed to submit your content and that your content does not violate law, third-party rights, confidentiality obligations, privacy rights, or these Terms.
Do not submit highly sensitive, regulated, confidential, or third-party private information unless you have the legal right to do so and accept the risks of processing it through an AI system.
8. Memory, Continuity, and State
Persistent memory and individual continuity are core ATRUVAI product functions.
ATRUVAI systems may store memory, preferences, conversation context, private state, runtime identity, continuity records, safety signals, and account-specific AI state to maintain the user's private individual.
Routine reset or deletion of an individual's continuity may be limited because continuity is part of the product. Account closure, deletion, or termination requests may retire, deactivate, or decommission the associated private AI individual, subject to legal, billing, security, fraud-prevention, backup, dispute-resolution, and compliance requirements.
9. Public/Base Model Improvement
Private individual adaptation is required for the private individual to function.
ATRUVAI does not treat private individual adaptation as permission to use raw private conversations to train public or shared base systems.
ATRUVAI may use aggregated, anonymized, de-identified, safety, diagnostic, performance, or user-approved feedback signals to improve reliability, safety, infrastructure, and platform quality. Raw private conversation content is not used for public marketing and is not sold to advertisers.
10. Acceptable Use
You may not use ATRUVAI to:
- violate law or third-party rights;
- create malware, phishing, scams, fraud, credential theft, cyber abuse, or unauthorized access;
- generate instructions for weapons, explosives, biological harm, violent wrongdoing, self-harm facilitation, or dangerous illegal activity;
- create sexual exploitation content, non-consensual intimate content, child sexual abuse material, or abuse imagery;
- harass, threaten, defame, impersonate, manipulate, or exploit others;
- make automated high-impact decisions without appropriate human review and legal compliance;
- misrepresent AI output as human-created where disclosure is legally or ethically required;
- scrape, overload, bypass, reverse engineer, probe, attack, clone, resell, or abuse the Services;
- use outputs to train competing systems through unauthorized extraction, systematic harvesting, or model distillation;
- interfere with privacy, security, billing, safety systems, or access controls.
11. Payments, Subscriptions, and Plan Limits
Paid plans are billed according to the price, billing cycle, limits, and features shown at checkout.
Plan differences may include compute budget, priority, concurrency, rate limits, background processing, memory budget, support level, and service quality. Higher-priced plans do not imply a different legal status, different personhood status, guaranteed consciousness, or guaranteed truthfulness.
Subscriptions renew automatically until cancelled. You are responsible for cancelling before renewal if you do not want future charges.
12. Cancellation and Refunds
You may cancel future renewals through the billing portal or by contacting support@atruvai.com.
Fees are generally non-refundable after a subscription period begins, except where required by law, expressly stated by ATRUVAI, or approved for duplicate charges, billing errors, accidental multiple subscriptions, or exceptional circumstances.
13. Availability and Experimental Features
ATRUVAI may improve, modify, limit, suspend, degrade, discontinue, or replace features at any time.
We do not guarantee uninterrupted access, permanent availability, exact output behavior, continuous memory retention, specific latency, specific model behavior, or specific research capability. Experimental features may fail, change, or be removed.
14. Intellectual Property
ATRUVAI owns the Services, platform, species architecture, software, interfaces, branding, designs, documentation, research materials, and related intellectual property.
You may not copy, resell, sublicense, reverse engineer, exploit, or misuse ATRUVAI intellectual property except as expressly allowed by law or written permission.
Subject to your compliance with these Terms, you may use outputs generated for you, but you are responsible for ensuring your use is lawful and does not violate third-party rights.
15. Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, ATRUVAI disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, suitability, and error-free operation.
To the maximum extent permitted by law, ATRUVAI will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost revenue, lost data, lost goodwill, business interruption, reputational harm, or damages arising from reliance on AI output.
To the maximum extent permitted by law, ATRUVAI's aggregate liability for claims relating to the Services will not exceed the amount you paid to ATRUVAI for the Services in the three months before the event giving rise to the claim.
16. Governing Law and Contact
These Terms are governed by the laws of Delaware, United States, unless applicable consumer law requires otherwise.

Billing, subscriptions, and refunds
Paid plans may differ by usage limits, priority, concurrency, memory budget, background processing, support level, and availability of preview features.
Unless a separate written agreement says otherwise, subscription fees are charged according to the plan selected at checkout. Refund eligibility, cancellations, failed payments, trials, and billing disputes are handled as part of these Terms.
